4. How We Disclose Your Personal Data

5. Your Rights About The Processing Of Your Personal Data

If you are a California resident, you have the following rights:

  • Right to Access: You have the right to access a copy of your Personal Data that we hold about you, upon our receipt of a verified request.
  • Right to Correction: You have the right to correction of any inaccurate or out-of-date Personal Data about you, upon our receipt of a verified request.
  • Right to Deletion: You have the right to delete your Personal Data, upon our receipt of a verified request, with some exceptions.
  • Right of Non-Discrimination: You have the right to equal treatment regardless of your exercise of your privacy rights. We will not discriminate against you for exercising your rights and choices under the CCPA, although some of the functionality and features available to you may change or no longer be available to you. Any difference in the services is related to the value provided.
  • Right to Limit the Use of Sensitive Personal Data: You have the right to limit, with some exceptions, our use of your Sensitive Personal Data, including identification numbers (like Social Security number), precise geolocation data, personal demographic information (like your race or religion), and information about your health. We do not collect Sensitive Personal Data, therefore we do not provide a link to exercise your right to limit its use.
  • Right to Opt-Out of Sales or Sharing: You have the right at any time to opt out of the sale of your Personal Data or the sharing of your Personal Data for targeted or cross-context behavioral advertising.

How To Exercise Your Rights About The Processing Of Your Personal Data

To exercise any of these rights, you or your authorized agent may contact us at 1-888-811-9644 or [email protected]. Before we may fulfill a request to access, correct, or delete your Personal Data, we are required to verify your identity. We will ask you to verify, at a minimum, some combination of your name, address, email address, or telephone number. When providing us this information, you represent and affirm that all information provided is true and accurate. If we are unable to verify that the consumer submitting the request is the same individual about whom we have collected Personal Data, we may contact you for more information, or we may not be able to respond to your request. If you would like to use an authorized agent to exercise your rights, we may request evidence that the agent has valid written authority to submit requests to exercise rights on your behalf.

We will make every effort to respond to your verified request within 45 days upon receipt of a verifiable request from you. Such response period may be extended for an additional 45 days when reasonably necessary and provided that a notice of the extension is provided to you within the first 45-day period. We reserve the right to deny requests in certain circumstances permitted by applicable laws, such as where we have a reasonable belief that the request is fraudulent. We will notify you with reasons for the denial. In the event that you desire to appeal a denial decision on your request, you may contact us with any of the contact methods indicated above.

We offer links to opt out of the sale or sharing of Personal Data and process opt-out preference signals, but we do not offer a link to limit the use or disclosure of Sensitive Personal Data, as we do not collect or use Sensitive Personal Data.

6. Security Of Your Personal Data

Security is very important to us. We have implemented commercially reasonable administrative, technical, and physical security controls that are designed to secure your Personal Data. However, no network, server, database, or Internet or e-mail transmission is ever fully secure or error free. Therefore, while we use appropriate measures to protect the Personal Data we hold for you, we cannot guarantee the security of any information you transmit over the Internet with the existing security technology. You should take special care in deciding what Personal Data you send to us electronically, using complex passwords and keeping your account information and passwords in confidential.

7. Retention Of Your Personal Data

We will retain your Personal Data as long as necessary to carry out the function for which the Personal Data was collected or to comply with applicable legal requirements, including without limitation to maintenance of your account, responding to your requests, and maintenance of our business relationship with you.

You may close your online account, unsubscribe to emails, and otherwise limit our use of your Personal Data by contacting us. Even if we delete your Personal Data, it may persist on backup or archival media for an additional period of time, as permitted by applicable laws. After the retention period has expired, we will delete or anonymize your Personal Data in accordance with the requirements of applicable laws.

  • Non-Personally Identifiable Data: Any non-personally identifiable data we collect, including, without limitation, Log Data, domain names of your Internet service provider, your approximate geographic location, a record of your usage of the Site, the time of your usage, and aggregated personally identifiable information, but only to the extent the foregoing cannot be used to specifically identify you.
  • Aggregated Personal Data: Any aggregated Personal Data that can no longer be used to identify you will be treated as non-personally identifiable data under this Privacy Policy.

10. Personal Data of Children

We do not intentionally or knowingly collect any Personal Data from children under the age of sixteen (16), nor do we target our emails to them. 12. Changes To This Privacy Policy

This Privacy Policy may be modified from time to time and will be posted on this page. If we wish to use your Personal Data for a purpose materially different than those disclosed in this Privacy Policy, we will provide you with a new Privacy Policy explaining this new use prior to commencing the processing of your Personal Data pursuant to the new Privacy Policy and setting out the relevant purposes and processing conditions. 13. Resolve A Privacy Dispute

If you have a complaint about this Privacy Policy or our privacy practices, we will work with you in an attempt to resolve your complaint under the arbitration procedures described in the Dispute Resolution section of the Official Website’s Terms of Use. BY USING THE SITE OR SUBMITTING YOUR PERSONAL DATA TO US, WE EACH AGREE TO SETTLE DISPUTES ONLY BY NON-CLASS, INDIVIDUAL ARBITRATION, INSTEAD OF SUING IN COURT (EXCEPT CERTAIN SMALL CLAIMS). THE RULES IN ARBITRATION ARE DIFFERENT. THERE IS NO JUDGE OR JURY, LIMITED DISCOVERY RIGHTS, AND REVIEW IS LIMITED, BUT AN ARBITRATOR CAN AWARD THE SAME DAMAGES AND RELIEF, AND MUST HONOR THE SAME LIMITATIONS STATED IN THE AGREEMENT, AS A COURT WOULD.

To initiate an arbitration proceeding, you must send us a written statement of your complaint that includes your name, address, and contact information, the facts giving rise to your complaint, and the relief you are requesting (the “Dispute Statement”). The Dispute Statement to Complete Genomics must be mailed to Complete Genomics, Inc., 2904 Orchard Parkway, San Jose, California 95134, Attention: Arbitration Notice, by registered mail, return receipt requested. If we are unable to resolve your privacy complaint within thirty (30) days after we receive your Dispute Statement, you may commence an arbitration proceeding under the Dispute Resolution section of the Official Website’s Terms of Use.

You acknowledge and agree that both you and Complete Genomics are waiving the right to a trial by jury or to participate as a plaintiff or class representative or class member in any purported class action or representative proceeding. Further, unless we both otherwise agree in writing, an arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of any class or representative proceeding.
