Complete Genomics, Inc. is committed to protecting the privacy of its users. This Privacy Policy describes how Complete Genomics uses and protects the privacy and security of information that we obtain from or about users (“you”) of our website located at www.completegenomics.com and other Complete Genomics websites, together with any mobile applications and social media pages or locations that correspond to such websites or are controlled by Complete Genomics (collectively the “Site”).

This Privacy Policy applies only to the data and information obtained by Complete Genomics through the Site and does not apply to any other data or information collected or obtained by Complete Genomics either online or offline. By accessing or using the Site, you agree to the terms of this Privacy Policy and consent to the use, collection and disclosure of your information as provided below. If you do not agree with this Privacy Policy, please do not provide Complete Genomics any information and do not use or access the Site.

Information Collected

Complete Genomics may obtain information and data from you when you provide it through the Site such as when you submit an inquiry through the Contact Us section of the Site or when you sign-up up or register on the Site, and/or when you otherwise communicate with us or request information from us through the Site. Information you provide may include personal information that can be used to identify or contact you (e.g., name, email, address, company affiliation or phone number) (“User Contact Information”) while other information you provide cannot be used in such a manner (e.g., text files, raw data, graphics, photos, video or audio files or other content or materials that you may enter, upload, post or otherwise provide to the Site) (“User Content”). As a general rule, you may remain anonymous while visiting the Site and viewing its content by not providing any User Contact Information, although some features and functionality of the Site may not be available to you as a result.

Complete Genomics may also obtain information about your use of the Site and your activity on the Site (e.g. browser type, domains, IP address, ISP, operating system, originating web links, page views, clicks, and length of visit on the Site) which may be collected through log files, cookies, and web beacon technology (which are discussed in more detail in the “Cookies” section below) as well as other technologies that keep track of your activity while using the Site. Such information about your use of the Site, together User Contact Information and User Content are collectively referred to in this Privacy Policy as “User Info”.

Use of Your Information

Complete Genomics may use your User Info to perform, operate, maintain, develop, provide, monitor and improve the Site and any related products or services of Complete Genomics. Complete Genomics may also use information you provide to contact you, respond to inquiries, provide support, customize or personalize your experience when using the Site or send you information regarding the Site, Complete Genomics or our products and services.

Complete Genomic may also use your User Info to compile and analyze trends and to develop, create, generate or otherwise obtain aggregated or de-identified information and data (which does not contain User Contact Information) which may by used or disclosed by Complete Genomics for any purpose in its sole discretion.

Disclosure of Your Information to Third Parties

Complete Genomics may share or disclose any User Info (a) in accordance with your consent, (b) to the extent already publicly available, (c) to the extent submitted, posted or provided to a public forum or public area of the Site, and (d) to affiliates and to third party, contractors, vendors, strategic partners or service providers of Complete Genomics who are only using such User Info in connection with the performance, operation, maintenance, development, provision, monitoring or improvement of the Site (or related products and services of Complete Genomics) and who are obligated to protect and treat such information in a manner consistent with this Privacy Policy.

For example, some of your User Contact Information may be shared on occasion with outside information technology service providers, lawyers, auditors, consultants and others we hire to assist in supporting the Site or associated services or performing other functions necessary to operate our business. As another example, Complete Genomics may use service providers to help host our Site, send emails, implement our marketing campaigns, measure the effectiveness of our advertising, conduct surveys or polls, obtain testimonials, or otherwise help us run or improve our Site, products, services and business. In all instances, such third party recipients act on Complete Genomics’ behalf with respect to such User Info and are not authorized to use your User Info for their own purposes or for the benefit of third parties (e.g., your User Info is not sold to others so that they can market to you). If Complete Genomics makes a disclosure of the type described above, the recipient must agree to safeguard and maintain the confidentiality of any User Contact Information it receives, use such information only for the purpose specified by Complete Genomics, and return or destroy such information following the specified use of the information.

Complete Genomics may provide general information about you and/or your use of the Site that does not allow you to be personally identified or contacted by third parties. For example, we might inform third parties regarding the number of various types of requests for information regarding our products or services that we receive through the Site.

Except as expressly described in this Privacy Policy, Complete Genomics does not provide User Contact Information to any third party without your express permission.

Required Disclosures and Uses

Complete Genomics may be required to disclose personal information in response to legal requirements, a search warrant, subpoena or court order. Disclosures and use of User Info may also be necessary to protect our legal rights, to protect the security or integrity of our Site or systems, to take precautions against liability or fraud, or during emergencies if physical safety or technical security is believed to be at risk. In all such cases Complete Genomics may use and disclose your User Information as necessary for the foregoing purposes.

Security

Complete Genomics understands that storing User Info in a secure manner is important to our business. Complete Genomics uses a variety of security measures to maintain the safety and confidentiality of such data and information. Complete Genomics stores User Info using reasonable and industry standard physical, technical and administrative safeguards that are designed to secure data against foreseeable risks, such as unauthorized use, access, disclosure, destruction and modification. In particular, all connections to and from our Site are encrypted using Secure Socket Layer (SSL) technology.

All User Contact Information provided to Complete Genomics through the Site is contained behind a firewall and only accessible by a limited number of employees who have special access rights to our production systems. Such User Contact Information provided to us is also encrypted in our secure database. The database is further protected behind a firewall. Unfortunately, no security measures are perfect or impenetrable. Even though Complete Genomics has taken reasonable commercial steps and efforts to prevent your User Info from being accessed, used, intercepted or disclosed by unauthorized individuals in violation of this Privacy Policy, you should know and you acknowledge that Complete Genomics cannot fully eliminate security and privacy risks associated with your information. Your provision of any User Info is done at your sole risk and responsibility. You expressly acknowledge that Complete Genomics is not liable for any special, indirect, consequential, incidental or punitive damages, costs, or liabilities whatsoever arising out of or resulting from your use of or access to the Site, including without limitation from your uploading, posting, providing, storing and/or using your User Info and any loss, disclosure or use thereof.

Cookies and Log Files

Your web behavior and activity in relation to the Site may be tracked and collected through cookies, pixel tags, log files, web beacons and other technology during your visit to or use of the Site.

Complete Genomics may place a “cookie” on the browser of your computer when you visit or use the Site. A cookie is a small file of information that a Site transfers to your computer for record-keeping purposes. The cookie itself does not contain any personally identifiable information, but may be used to tell when your computer has contacted the Site, thus enhancing your experience as a user of the Site. For instance, the Site’s use of cookies allows you to avoid registering or logging in each time you visit the Site to download resources. Complete Genomics may also use cookies to do things like: remember preferences and settings; keep your account secure; mitigate risk and prevent fraud; better understand how people are using our Site, and improve and promote Complete Genomics based on that information. You can set your browser to not accept cookies, but this may limit your ability to use the Site and any related services.

A pixel tag (“pixel”) is a small piece of code that can be embedded on websites and emails. Complete Genomics may use pixels to learn how you interact with our Site and emails. Do Not Track (DNT) is an optional browser setting that allows you to express your preferences regarding tracking by advertisers and other third parties. If our systems receive a DNT:1 signal from your browser, Complete Genomics will stop using pixels to promote our Site, products and services on third-party sites accessed via that browser.

When users visit and use our Site, Complete Genomics gathers certain information automatically and stores it in log files. This information includes without limitation Internet Protocol (IP) addresses, browser type, Internet Service Provider, referring/exit pages, operating system, date/time stamp, and clickstream data (i.e. a list of pages or URLs visited). This information may be linked to a particular user’s profile ID or order number. Complete Genomics may use this information as described above.

Business Transitions

In the event that Complete Genomics goes through a business transition such as a merger, acquisition by another company, or sale of all or a portion of its assets, your User Info will likely be among the assets transferred and disclosed to the acquiring or successor entity and such use and disclosure is permitted under this Privacy Policy. In such a case, your information would remain subject to the promises made in the Privacy Policy existing at the time of such transaction.

Notification of Changes

This Privacy Policy may be revised from time to time as we add new features and services, as laws change, and as privacy and security policies and practices evolve. Notice will be provided on the Site of any major changes Complete Genomics makes to this Privacy Policy. Small changes and changes that do not significantly affect individual privacy interests may be made at any time without notification. Your continued use of the Site shall constitute your acceptance of and agreement to any modified or amended Privacy Policy.

Opt-Out From Receiving Certain Communications

When you submit an inquiry via the “Contact Us” pages of the Site, you may receive materials regarding Complete Genomics’ products and services by mail or e-mail. You may opt out of receiving these materials at any time by unsubscribing through an email that you receive from us, by visiting the “Contact Us” page of the Site or contacting us by e-mail at info@completegenomics.com.

Children’s Privacy

Complete Genomics is committed to protecting the privacy of children as well as adults. The Site is currently not designed or intended for use by children under the age of 18.

Access, Correction, and Contacting Complete Genomics; Warranty Disclaimer

You may contact Complete Genomics a) by visiting the location on the Site designated: Contact Us or b) contacting us by e-mail at info@completegenomics.com, if you believe information concerning any of your User Contact Information is inaccurate, incomplete, or if you want to change or delete any information about you that Complete Genomics may have collected. Complete Genomics will use good faith efforts to respond to any such request but has not obligation or liability for any failure to correct, complete, change, store, retain or delete any of your User Info.

Unless expressly provided otherwise in writing by Complete Genomics, the Site and any associated products or services are provided “AS IS” without warranty of any kind. Complete Genomics makes no, and hereby disclaims any and all, representations and warranties of any kind, express or implied, with respect to the Site and any associated products or services, including without limitation, warranties of merchantability, fitness for a particular purpose and non-infringement.

International Transfers of Information

Your User Info may be transferred to – and stored or maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to us, Complete Genomics transfers User Contact Information to the United States and processes it there, and your submission of such information represents your agreement to that transfer.
